Solicitation to Vendors for Criminal Court Quotes

The District Court of the First Circuit of the Judiciary, State of Hawaii, is soliciting quotes to fabricate, print and deliver 120,000 sets of Notice of Entry of Judgment and/or Order also known as Traffic Court (Traffic Disposition form) Contractor shall be responsible for all costs for labor, equipment, materials, transportation and other appurtenances necessary to provide such forms.

Sample forms are available upon request, for inspection of construction. Contractor is required to produce forms identical to the sample in every aspect, except wording changes as shown on the PDF file. The Judiciary has included written specifications; however, the Judiciary makes no warranty that these written specifications are in fact identical in all aspects with the sample provided. Sample shall control.

Quantity as listed in the specifications is for the exact quantity. Contractor must deliver the exact quantity-no overages or shortages. Shipping, and delivery freight to floor. The Judiciary will not pay for any overages that the contractor delivers. However, should there be a need to increase the total quantity prior to runoff, the price per set for the additional quantity shall be the same or less that the price quoted.

All deliveries, including air freight order shall be made to the location indicated below unless otherwise instructed in this section, and shall include any forklift delivery freight to floor, the stacking of the pallets or cartons of forms in the appropriate drawing sequence for easy retrieval.

Instructions
  • OFFEROR SUBMISSIONS: Offerors shall submit the required OFFER FORM Traffic Disposition and SPO FORM 8 SOH Certification of Recycled Content through HIePRO
  • TOTAL BID AMOUNT: Total Bid Amount shall be entered into HIePRO and shall include taxes, freight delivery and all applicable costs. Amount should agree with the bid price indicated/quoted in the OFFER FORM submitted through the Hawaii State eProcurement System (HIePRO).
  • INVOICING AND PAYMENT: Contractor shall submit an original invoice detailing the number of forms delivered. Payment shall be made to the contractor upon certification that the contractor has satisfactorily delivered the forms as specified.
  • RESPONSE TO THIS SOLICITATION: Only responses submitted through HIePRO shall be considered for award.
  • ORDER FULFILLMENT: Quantity as listed in the specifications is for the exact quantity. Contractor must deliver the exact quantity-no overages or shortages. The Judiciary will not pay for any overages that the contractor delivers. However, should there be a need to increase the total quantity prior to runoff, the price per set for the additional quantity shall be the same or less that the price quoted.
  • QUESTIONS ABOUT THIS SOLICITATION: Unless otherwise indicated, questions regarding this solicitation must be directed to the Buyer listed.
  • TRANSACTION FEES: The awarded vendor shall pay a transaction fee of 0.75% (.0075) of the award, not to exceed $5,000 for each award. This transaction fee shall be based on the original award amount and the awarded vendor shall be responsible for payment of the fee to Tyler Hawaii, the vendor administering the HIePRO. Payment must be made to Tyler Hawaii within thirty (30) days of receipt of invoice. The invoice is generated based on the date the award is posted.
  • AIR FREIGHT: If air freight is required to meet the agreed-upon delivery deadline, the Contractor shall be responsible for the additional air freight costs when the delay is attributable to the Contractor, its subcontractors, suppliers, or carriers. The Judiciary shall be responsible for air freight costs only when the delay is caused by circumstances beyond the Contractor’s control, as determined by the Judiciary, and not due to any fault or negligence of the Contractor, its subcontractors, suppliers, or carriers. The Contractor shall immediately notify the Judiciary of any anticipated delivery delay and obtain the Judiciary’s prior written approval before incurring any expedited or air freight costs, except in an emergency.
  • OFFER DEEMED FIRM/AUTHORITY TO SUBMIT OFFER: Submission of an electronic response to the State of Hawaii constitutes and shall be deemed an offer to sell the specified goods and/or services to the State of Hawaii at the price shown in the response and under the State's Terms and Conditions. The electronic response submitter certifies that he/she is authorized to sign the response for the submitting vendor and that the response is made without connection with any person, firm, or corporation making a response for the same goods and/or services and is in all respects fair and without collusion or fraud.
  • HAWAII GENERAL EXCISE TAX (GET): Unless otherwise stated in this solicitation, vendors shall include all applicable taxes in the price submitted. The Hawaii General Excise Tax (GET) shall not exceed 4.712% for the islands of Oahu, Kauai , Hawaii, and Maui.
  • ADDITIONAL FEES AND CHARGES: Vendors shall include all applicable fees, charges, surcharges, shipping/handling, delivery, or any other charges associated with this solicitation in the price submitted.

  • DELIVERY INSTRUCTIONS: Quantity as listed in the specifications is for the exact quantity. Contractor must deliver the exact quantity-no overages or shortages. However, should there be a need to increase the total quantity prior to runoff, the price per set for the additional quantity shall be the same or less that the price quoted. All deliveries, including air freight order shall be made to the location indicated below unless otherwise instructed in this section, and shall include any forklift delivery freight to floor, the stacking of the pallets or cartons of forms in the appropriate drawing sequence for easy retrieval. Delivery Instruction List: All Traffic Disposition forms (120,000) shall be delivered directly to the District Court of the First Circuit. The actual delivery date shall be determined upon negotiations with the awarded vendor. If Contractor is unable to deliver Traffic Disposition forms by delivery due date, Contractor’s offer may not be accepted for award. If Contractor fails to make timely delivery as provided herein, in addition to any other recourse which the Judiciary may have, the Judiciary may terminate the Agreement in accordance with the General Conditions. Prior to delivery, please contact Erica Uahinui at 538-5127 for instructions. Delivery shall be made during the Judiciary’s normal delivery hours between 9:30 am-11:30 am and 1:30 pm- 3:30 pm Hawaii Standard Time. Monday through Friday, except for State Holidays and/or days when work is not officially scheduled.
  • COMPLIANCE AND DOCUMENTATION: Vendors are required to be compliant with all appropriate state and federal statutes. Proof of compliance is required through HCE or via paper documentation.
  • VENDOR REGISTRATION IN HAWAII COMPLIANCE EXPRESS (HCE) : Vendors can register at https://vendors.ehawaii.gov/hce via an annual subscription fee and should subscribe prior to responding to a solicitation.   • VENDOR COMPLIANCE – PAPER DOCUMENTS : Vendors not utilizing HCE shall provide paper certificates that must be valid at the time of award. All applications for applicable clearances are the responsibility of the vendor, who must be compliant pursuant to HRS§103D-310(c) with the chapters 1) Chapter 237, General Excise Tax Laws; 2) Chapter 382, Hawaii Employment Security Law; 3)Chapter 386, Worker’s Compensation Law; 4) Chapter 392, Temporary Disability Insurance; 5)Chapter 393, Prepaid Health Care Act; and 6) §103D-310(c), Certificate of Good Standing (COGS) for entities doing business in the State. Upon receipt of compliance paper documents (A-6, LIR#27, COGS), the purchasing agency reserves the right to verify their validity with the respective issuing agency.
  • VENDOR NON-COMPLIANCE : NON-COMPLIANCE may result in a vendor not receiving an award, delay of payment, or cancellation of award. If the vendor does not maintain timely compliance, which is the vendor’s responsibility, an offer otherwise deemed responsive and responsible may not be awarded. State agencies may check for compliance at any time.
